Windcrest hired an Attorney to contact the WVDF
Association. The Association Attorney
responded with these comments to the Attorney hired by the City. The association released all records required
by law, see below.
Attached are the tax returns for the last 3 years.
The WVFD Association is an
independent 501(c)(4) and is not a city department. The relations between the
city and the fire association are strange, at best, given the ownership of the
vehicles, how donations are handled, etc…
Your email response to my
letter did not answer why you think you have the power as “special counsel” to
access the association records; much less threaten the association with
subpoenas.
Regardless, as far as the
association is concerned, the city has no authority to conduct an investigation
of the association, just like the association cannot hire me to investigate the
mayor or city.
I am simply not going to allow you to speak to
the association members or have access to records other than the documents the
IRS requires we provide. This investigation is clearly politically motivated,
any assertion otherwise is naïve, disingenuous, or both.
My clients have done nothing
wrong and have nothing to hide. That said, I am not going to allow you or
anyone to bully your way in on a witch hunt looking for wrongdoing when you
have absolutely no evidence of any. If you have any evidence, please provide to
me and I assure you we will conduct a thorough investigation of your
assertion(s). Absent that, I trust you will cease threatening or contacting the
association or its members.
